There are a lot of rules of thumb for copyright
infringement - and not a one of them worth a flip
based on my litigation experience. The real test
is whether the use made will interfere with the
market for the copyright, which could be book
sales or adaptations or any of the exclusive
rights.
Also, the extent of the copyright in complitations
of facts is pretty small. the old Sweat of the
Brow protection for things like the Yellow Pages
has been rejected by the Supreme Court.
Given the ephemeral nature of e-mail, I don't
lose any sleep over my occasional forwarding of
material. (everything - including this e-mail is
copyrighted, by virtue of being fixed in a
tangible means of expression capable of being
machine read (or otherwise).
