John Baker & Ann Norfleet Let me first start with the way I see their family and then I will explain why I have come up with this conclusion. John Baker Jr. born about 1755 in Bertie Co. NC married about 1778 died 22 Dec 1829 Montgomery County Tennessee Son of John Baker Sr. and Elizabeth Wilson who were married 5 Sep 1754 in Bertie Co. Tn. John Baker Jr. Married Ann Norfleet about 1778 Ann Norfleet born after 1756 married about 1778 died Sept 1831 Montgomery County Tennessee Ann Norfleet was the daughter of Marmaduke Jr. of Perquimans County, North Carolina Children of John Baker and Ann Norfleet Robert Baker born 1778-1780 James Baker born 1778-1780 Ann Baker born about 1780 William Baker born about 1782 John Baker born about 1784 Lucinda Baker born about 1786 Now I will explain my views. First of all John Baker Jr.'s birth year of 1755 comes from the fact that his mother and father were married 5 Sep 1754 so his birth would be after that date. He could be the son of John !
Baker Sr. and an unknown wife and have a birth year early. Some people's genealogies have that John Baker Jr. was a son of Mary Ann Wynns but this is wrong because Mary Ann Wynns was born about 1740. This coming from the guardianship papers for the orphan children of John wynns in 1759 [point 1 below]. Also in 1757 Mary Ann Wynns in a marriage contract between Burrill Bell and Sarah Wynns late relect of John Wynns [point 2 below], if Sarah were to die then her property would be held in trust for her kids, including Mary Ann. This would mean that Mary Ann was under the age of 18 in 1757. Then in 1759 Mary Ann is not listed as one of John Wynns' orphan children probably meaning that she turned 18 by then. Also in John Wynns will of 1753 Mary Anney is listed after James Boon and before Watkin William, this would suggest that Mary Ann was born before Watkin William who was born 30 Sept 1742. So with Mary Ann being born about 1740 she would be too young to be John Baker Jr.'s mo!
m. Second is the date of the marriage for John Baker and Ann Norfleet
as being about 1778. This come from {Recollections of the Baker Family (Written in 1847) By Dr. Simmons Jones Baker of Scotland Neck, North Carolina } Dr. Baker states that John Baker was wounded in the Battle of Brandywine and then after recovering from his wound he was married to Ann Norfleet. The Battle of Brandywine was in 1777 presuming that it took about a year or less to recover we come-up with 1778. Then we come to Ann Norfleet being the daughter of Marmaduke Norfleet. This comes from a deed in Martin Co. NC [point 3 below] This deed clearly states that Ann was the daughter of Marmaduke Jr. and the wife of John Baker of Gates Co NC. Then there is the birth date for Ann Norfleet as being after 1756. This comes from her grandfather (Marmaduke Norfleet Sr.) 's will. Marmaduke states that the negroes that he let his son Marmaduke use in his life time be split between his daughters, Abseley Bell and Ann Norfleet when she turns 18 years of age. This will is dated 28 June 1!
774 so this would mean that Ann was born after June of 1756. Then there is the children of John Baker and Ann Norfleet. Robert, James and William come from a oral will of William Baker who died in the War of 1812. [point 4 below] ************************************************************ [point 1] #476 April Ct 1759 - Watkin William Wynns Orphan of John Wynns Deced. about the age of Sixteen years of age and Sarah Amelia Wynns Orphan of the said Deced. about the age of fourteen years came into court and Pray'd Leave to Choose Burrill Bell for their Guardian, which was Condidered off and Granted. Order that he be and John Baker, Esquire, James Boon Wynns and Ralph Outlaw appeared in Ct and offered themselves as Security. John Baker atty at Law then Prayed that Burrill Bell be appointed Guardian to John Augustus Wynns and Winnefred Caroline Wynns orphans of John Wynns Deced. This said petition was rejected. #491 June Ct 1759 - Burrill Bell who was appointed Guardian to Watki!
n William Wynns, John Augustus Wynns, Sarah Amelia Wynns & Winnefred C
aroline Wynns orphans of John Wynns deced. by this court at its last sitting Acquainted the Court that John Baker Esquire one of his then Securities desired to decline his suretyship and thereupon refused to execute the bonds that were prepared for that purpose. And at the same time the said Burrill Bell moved for leave to present to the Court one other Security in the Room of the said John Baker which was granted and also at the same time Capt. James Jones appeared in Court and offered himself as Security in the room of the said John Baker who was approved by the court. Thereupon it was ordered that the said John Baker should be erased out of the said Bonds and James Jones should be inserted. *********************************************************** [point 2] July 18, 1753. tate consisting of negroes money and other chattels" wished to make provision for her five children. Five negroes and 25 settled on Benjamin Wynns and Nicholas Perry provided Sarah Wynns have use of them during her natural life. Should Burrell Bell survive Sarah; "then in trust for Mary Ann Wynns, John Augustus Wynns, Winnifred Caroline Wynns, William Watkins Wynns, Sarah Amelia Wynns children of Sarah Wynns or such of them as shall be living at that time to be equally divided among them...." Wit: William Wynns. April Court 1757. Benj.
