--Will
I, H. F. Kern, of Winchester, Va., being of sound mind
do make this my last will and testament hereby revoking all former wills
made by me.
First, I direct that all my just debts shall be paid
that a suitable monument shall be erected at the graves of my wife and
my self.
Second, I give and devise all of my real estate to my
wife, Jane Ann Kern, to be held and enjoyed by her as long as she lives
and
remains my widow, upon the death or re-marriage of my said wife, I give
my said real estate to my children share and share alike, and if any of
my said
children should die leaving children before getting possession of his or
her
share it is my wish that the children of the one so dying shall get the
parents share.
Third; as to my personal property I give to my wife absolutely
all my household effects. As to the money and all evidences of debt which
I
may have at my death it is my will that my wife shall use so much of the
same as she may need for her proper support, but I expressly request her
not
to loan any money to her children or to any one else. It is my desire that
she
shall leave it in bank at interest and use it as she may need it, and what-
ever remains at her death after paying funeral expenses, physicians, fees
& c.
shall be divided equally among my children.
Fourth, I appoint my son John W. Kern my executor without
security.
Witness my hand and seal to this my last will and testament
in the presence of the subscribing witnesses this 5th. day
of November, 1912.

Signed, sealed and published and delivered by the testator H. F. Kern,
as and for his last will and testament in our presence and we in his presence
at his request and in presence of each other have subscribed our names
as
witnesses thereto this November, 5, 1912.

IN THE COUNTY CLERKS OFFICE OF FREDERICK COUNTY , VIRGINIA.
On this 27th. Day of July, 1914, the Last Will and Testament
of H. F. Kern was produced to the County Clerk of said County and fully
proven
by M. M. Lynch and A. J. Tavenner, the subscribing witnesses thereto, who
appeared in the Clerks Office and being duly sworn and examined by the
Clerk,
proved that H. F. Kern, in their presence, (they being together) signed,
acknowledged and declared said paper to be His Last Will and Testament,
and
that they ( M. M. Lynch & A. J. Tavenner) at the request of said H. F.
Kern,
in his presence, and in the presence of each other, signed their names
as
witnesses thereto, and that said H. F. Kern was, at the time, of sound
and
disposing mind; and said will is ordered to be recorded, and on motion
of
Jno. W. Kern, the executor therein named, who made oath according to law,
Certificate for obtaining a probate thereof in due form is granted him
on
his executing his bond, etc., without security agreeable to the provisions
of the Will whereupon he acknowledged bond in the penalty of $500.00
according to law and took the prescribed oath.

[Note: Henry Furlong Kern died 22 July 1914 and is buried in Mount Hebron
Cemetery, Winchester. His wife, Jane Ann Boyd died 13 Nov 1936 and is also
buried in Mount Hebron Cemetery. Their children were - John W. Kern (married
Emma Nicewarner); Laura J. Kern (married William L. Poston); Mary A. Kern
(married Charles Baker); George Philip Kern (married Harriet E. Ritter,
Annie Jane Mason, & Elizabeth R. ___); Ida Elizabeth Kern (married James
Baecher); Charles Luther Kern (married Ada Elizabeth Weaver); Henry R.
Kern (married Ethel Crim); and Bessie May Kern (married Howard Ebersole)]
