In the June term 1838 of the Montgomery County Chancery Court, John Olinger filed a case against the heirs of Samuel Ullery deceased. As Petitioner, Olinger owned the dower and rights of six of the heirs in the Ullery land described as 72 acres in the SE 1/4 section 28 of Madison Township. The heirs are the [unnamed] widow who has since married Jacob Swinehart and her nine children: Barbara w/o Christian Shively, Elizabeth Ullery, Esther w/o Samuel Shively, Susannah w/o Jacob Ullery, John Ullery, Sarah w/o Samuel Ullery all of age and minors Samuel 19 on May last, Hannah 16 and Catherine Ullery 14. Olinger was asking for a settlement and the balance of the land.

On the same day, 6 June 1838 and in the same Court, Jacob Swinehart filed suit against Samuel, Hannah and Catherine Ullery. The record reads that Samuel Ullery died owning the NE corner of section 34 in Madison Township, 146.36 acres originally conveyed to David and Barbary Ullery 23 Dec 1812. Swinehart holds dower rights and six shares and is asking for a petition of the land.

On 26 Feb 1838, Samuel age 19 and Hannah Ullery 16 children and heirs of Samuel Ullery chose Jacob Swinehart and Esther Swinehart their guardians. Christian Shively posted the security.

Samuel Ullery was a son of David and Barbara [unknown] Ulrich Sr and grandson of Stephen and Elizabeth [unknown] Ulrich II. Samuel's widow Esther Cripe Ullery and her second husband Jacob Swinehart moved from Montgomery County OH to Kosciusko County IN where both spent the remainder of their lives.

I suspect that the family you are actually interested in is Stephen rather than Samuel Ullery.
Stephen Ulery, a brother to the above named Samuel Ullery, married Susannah Shively, daughter of Christian Shively Sr and Susannah Gripe, who in turn married the widower Henry Harshbarger in 1834 and remained in Montgomery County OH. The children of Stephen and Susannah were:

The names in this family grouping fit the names of your original query. If this is the case, Samuel joined by his wife Susanna was an heir rather than the deceased parent. Do you have a copy of the actual deed or an abstract? I would be very interested in the complete date of transaction, section, town and range of the land.
